Privacy Notice
Who We are
This service is operated by Assurant Europe Insurance, N.V. The controller for the processing of your Personal Data in relation to Technical Support is Assurant Europe Insurance, N.V, part of the Assurant, Inc. group companies (‘’We’’, ‘’Us’’, ‘’Our’’ or ‘Assurant) located at Avenida de Europa, 19 – P.E. Ática XIX, Edif. 3, Pl. 1.28224 Pozuelo de Alarcón.
This privacy notice applies only with respect to Personal Data collected in support of your use of the service and does not reflect Our practices with respect to information gathered through other Assurant services, websites or other applications. For information about other services of Assurant, please refer to the respective privacy notices applicable to such services.
Personal Data We collect from you
We may collect and use the following information about you when you visit the Web Portal and for the provision of the services under the insurance policy:
- Name and contact details (e.g. postal address, phone number, email address),
- Internet Protocol (IP) (e.g. when you visit the Web Portal),
- Policyholder information (e.g. policy number, certificate number, billing information and payment history)
- Covered device information (e.g. make, model, serial number, IMEI),
- Records of any correspondence related to specific enquiry, and
- Feedback provided by you about Our services.
You can choose whether or not to share this information with us. If you do not provide any of this data, We may not be able to provide you with certain services under this policy.
Our purposes and lawful grounds for the processing of your Personal Data
We will only process your Personal data when we have a legal basis. Please see below our legal basis together with the purposes.
The performance of the contract which includes the provision of the insurance policy, verifying your identity, processing your information regarding the purchase of Our products and services, calculating your cover price and excess, and communicate with you.
Where necessary to pursue Our legitimate interests, in particular:
- For the purposes of statistical analysis, customer surveys (where permitted under applicable law) for internal administrative functions, management of customer information requests, customer relationship management and evaluation of the quality of the insurance policy and its benefits.
- Monitor and improve Our offers and customer experience and manage Our internal procedures in accordance with Our tests and standards.
- Risk evaluation and management (including operational risk), debt recovery, fraud and payment default prevention and evidence management. We use your information for these purposes where necessary for pursuit of our legitimate interests (protecting our business from fraudulent activity and recovering sums due).
- Anti-money laundering, anti-terrorism efforts and sanctions screening.
- To improve the safety, security and performance of Our services.
Compliance with legal obligations. For example, where We have a legal obligation to use your Personal Data for the prevention of money laundering and terrorist financing and implementation of the sanction’s regime. We will use your Personal Data whenever necessary to comply with Our legal obligations.
Where you have consented to the use of your Personal Data for the purpose We explain at the time. E.g. when you visit the Web Portal We place cookies and use similar technologies in accordance with Our Cookie Policy. You will always be able to withdraw your consent by contacting Us or using the mechanism described to you at the time that your consent was obtained.
Personal Data We obtain From Other Sources
We may process Personal Data about you that We obtain from third parties. We will obtain your name, contact details, insurance policy details (e.g. coverage level) from your telecommunications service provider through which you may have purchased this insurance product directly. We also receive information about you (relating to your identity and previous claims made) from fraud prevention agencies and similar organisations to help Us make decisions about your insurance policy and claims for compensation.
How We share your Personal Data
- Other companies in Our Assurant group of entities.
- Third party suppliers of services, such as your telecommunications service provider, couriers, customer support, customer communications, audit, application or database hosting, device warehouse and repair centers, entities responsible for the management of claims for compensation.
- Fraud prevention services and databases; if you provide Us with false or inaccurate data, and We suspect the possibility of fraud, We will verify the data with fraud prevention services.
- Public Authorities: if required by law or for the legal protection of Our legitimate interests in compliance with applicable law We may disclose your Personal Data to public authorities.
How long We keep your Personal Data
Your Personal Data will in principle be retained no longer than is necessary. This means that your personal data will in principle be retained no longer than 6 years after termination or cancellation of your Policy to respond to questions, complaints or enquiries. However, we may retain your personal data longer if this is required to comply with a law or regulation to which we are subject or necessary for us to protect or exercise our rights, for as far as allowed under the applicable data protection law. In addition, We keep logs and backups for the purposes of security, debugging and stability of the page, up to 30 days.
Automated decision-making and profiling
In certain circumstances We use automated decision-making tools. We typically use these tools when We make direct decisions about the policyholder (e.g. in certain compensation claims management processes). These decisions do not include human intervention, but the software and system predefine the programming and logical criteria applied to make the decision and evaluate how we respond to you in the provision of our services. You will be given additional information about automated decision-making processes before, or at the moment We want to make decisions. If you do not agree with the result of the decision taken by solely automated means, you can request human review of the decision, express your point of view, and obtain an explanation of the decision. In general, we make no use of automated decision-making or profiling. Where necessary, we will inform you separately about such measures in individual cases.
International Transfers
In the context of the purposes described above, your personal information may be transferred outside the European Economic Area (EEA) to countries that are not considered to ensure an adequate level of protection of personal information. We will ensure that appropriate Standard Contractual Clauses are in place for those countries with privacy laws that do not have adequate protection. We may also rely on our vendor’s Binding Corporate Rules. Your rights and choice
You have the following rights regarding your personal data:
- Right to access the personal data We hold about you.
- Right to rectification (correction) of your personal data when incorrect or incomplete.
- Right to erasure of the data We hold about you, when We have no legitimate overriding interest, or once the purpose for which We hold the data has come to an end.
- Right to restriction of the use of your personal data, generally while We are deciding on an objection you have made.
- Right to withdraw your consent at any time when the processing is based on your consent. We may be able to continue to process your personal data in some limited circumstances if We can base such processing on another valid legal basis.
- Right to restriction of processing, this means that the data will be blocked from normal processing but not erased.
- Right to data portability where processing is based on your consent, or on a contract.: the right to obtain a copy of the data concerning you in a structured, commonly used and machine-readable format and the right to transmit those data to another controller without hindrance from us.
- Right to object to the processing of your personal data based on Our legitimate interests, provided that there are no compelling legitimate grounds for the processing that would override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims. Please note that in certain situations, and subject to applicable law, We may not be able or obliged to comply with all your requests, for example comply with a deletion request relating to information We are required by law to keep or have a compelling legitimate interest in keeping. We may charge you a reasonable fee in case you request additional copies of your Personal Data or make excessive requests. If We are unable to honor your request, or before We charge a fee, We will expressly inform you. In so far as practicable and required under law, We will notify third parties with whom We have shared your Personal Data of any request for correction, deletion, and/or restriction to the processing of your Personal Data. You always have the right to lodge a complaint with your local Data protection Authority.
Information Security
We have implemented safeguards designed to protect your Personal Data in accordance with industry standards. We have measures in place to restrict access to Personal Data to those individuals whom We know have a valid business purpose to have access to such information. We maintain physical, electronic and procedural safeguards. However, no method of transmission over the internet or method of electronic storage is totally secure. Therefore, We cannot guarantee its absolute security.
Minimum age
We do not knowingly collect information from children under the age of 18. You must be at least 18 years old to use the Service.
Changes to this Notice
We may from time to time update this privacy notice. If We make material changes to Our notice, We will notify you by email or by means of a notice through the Service. We recommend that you check this Notice regularly to keep up-to-date.
