This Privacy Notice describes the information handling and privacy practices of Assurant, Inc. and its subsidiaries and affiliates (collectively, “Assurant”) in connection with the Mobile App on which this Privacy Notice is posted. The Privacy Notice describes our practices with respect to the collection, access, use, management, disclosure, transfer, storage and other processing of your personal information processed in connection with the Mobile App.

Assurant, Inc. through its affiliated companies, The Signal, L.P (hereinafter, “We”, “Us”, “Our” or “Company”), respects your concerns about privacy. If you reside in the United States, then the personal information provided to or collected by Our Service is controlled by Assurant, Inc., 28 Liberty Street, New York, NY 10005 U.S.A. This Pocket Geek Home Privacy Notice (“Notice”) describes how We will collect, access, use, disclose, retain, transfer, otherwise process and protect personal information when you use the Service, a service that provides Our customers with the ability to inventory, manage, and troubleshoot your connected home devices, and send mobile device diagnostic information to troubleshoot issues with your mobile device, all from the Pocket Geek Home Mobile App.

We protect your personal information using industry standard safeguards. We may share information about you with your consent, where it is necessary to carry out the Service or as required by law, and We will always let you know when We make significant changes to this Privacy Notice.

We adhere to the following principles to protect your privacy:

We protect your personal information and will only provide it to third parties:

  2. where it is necessary to carry out your instructions;
  3. as reasonably necessary in order to provide the Service;

This Privacy Notice applies to the Service only and does not necessarily reflect practices with respect to information gathered through other services We offer or Mobile sites We operate or the collection of information through off-line means. If you have any concern about providing information to Us or your information being used in any manner permitted by this Privacy Notice and the Pocket Geek Home Terms of Service, you should not visit Our Mobile App or otherwise use the Service.

1. What information We collect

When you use the Pocket Geek Home Mobile App, We may collect information (including your name, email address, phone number, type of mobile device, mobile device diagnostics, and devices you add to your inventory. With your permission, we may also access information from your device, such as your general location, contact lists, SMS messages, Call logs, photo and video library, documents, music. This information is only accessed if you grant us access to it, and if it’s required for the service to operate, or required for specific features of the service to operate.

We collect your personal information in the following ways:

1.1 When you use our Service

When on the Pocket Geek Home Mobile App; to access its features and so that We can administer the Service, We ask users to provide Us with: (i) name (ii) email address, and (iii) phone number. The Service may also collect diagnostic information about the mobile device on which you have installed the Mobile App, such as device settings (e.g. Wi-Fi On/Off), device name (e.g., “John’s phone”), activities (e.g., Bluetooth was disabled), device performance profiles, malware signatures, and your IP address.

1.2 When you communicate with Us or contact Us for Technical Support

We collect information when you contact Us for Technical Support.

When you contact Our customer support (for example, when you use Our Tap to Talk or Tap to Chat function), We will collect information that you provide to Us in your communications (such as the query or issue that you have raised).

With your permission We will access your personal information contained within the Service or your Device to respond to your request. When Our Technical Support advisor accesses your device for troubleshooting purposes, while the Technical Support Advisor is logged in to your account, she or he can access and extract information (such as settings) from the device. The Technical Support advisor will only access information needed to troubleshoot the device, and once the session is over, they will not retain any of the information on their screen. Please note that when you use Technical Support, Our advisors may be able to view messages and communications sent to the Device while providing support services. We do not retain or use this information for any purpose.

1.4 When you use the Mobile App

We collect information when you visit Our Mobile App.

We use tracking technologies for the following purposes: (i) to operate the Pocket Geek Home App which is essential in order to enable you to move around the Mobile App); (ii) to provide you with recommendations that may interest you (including on third-party Services) (iii) to personalize the content we present you in the Pocket Geek Home Mobile App which allows the Mobile App to remember choices you make and provide enhanced, more personal features), (iv) to understand how the Pocket Geek Home Mobile App functions and are used and to provide or improve the Mobile App, which are used to collect information about your use of the Pocket Geek Home Mobile App.

Our third-party partners may employ images and scripts that help them better manage content on the Mobile App. We may combine information from third parties with information gathered through the use of the Service for market research, analysis and trending purposes 1.5 Links to other Mobile sites

We are not responsible for the privacy and security practices of those Mobile sites, and We encourage you to learn about the privacy and security practices of those Mobile sites if you choose to access and use them.

2. How We use and disclose collected information

You agree that information you provide may be used as described in this Notice and our Terms of Service.

2.1 Consent to Processing Information about You

By downloading, accessing, or using the Pocket Geek Home Mobile App you indicated that you have read this Notice and expressly and voluntarily accept the terms of Our Terms of Service and freely consent, on your own behalf and on behalf of any family members you have authorized to use the Service, to Our processing of personal information as set forth in this Notice. If you do not consent to the terms of this Notice, do not access or use the services offered on this Mobile App.

We do not sell or rent any of your personal information.

The personal information We collect through your interaction with the Service is used to provide the Service, to manage your account for the Service, to manage Our business and to improve the Service for yourself and other users of the Service, to develop new products and Services, and for other purposes to which you consented. We communicate with you through mobile text messaging (e.g., SMS) only to provide a link to download the mobile app and to provide information related to the Pocket Geek Home program and mobile app. These messages will be sent to you based on your registration information. You may choose to opt-out of receiving this communication by replying STOP or CANCEL to the received text message (SMS).

3. How We share your personal information

3.1 Sharing information with affiliates

We may share your information among the Assurant family of companies.

The Assurant entity that collects or holds your personal information shares your personal information with Our affiliates (meaning entities controlled by, controlling or under common control with Assurant, Inc.) for the purposes stated in this Privacy Notice.

3.2 Sharing personal information with service providers

We employ third party companies and individuals to facilitate the Service (for example, customer support, analysis, audit, application, database hosting).

These third parties have limited access to your information only to perform these tasks on Our behalf and are obligated to Us. The personnel of such third parties who use your personal information is limited to those individuals which are authorized to do so on a need-to-know basis and as necessary to provide these business services to Us. We do not authorize such third parties to disclose or use it for other purposes.

3.3 Sharing personal information with other recipients

We may disclose your personal information to public authorities if mandated by law or if required for the legal protection of Our legitimate interests in compliance with applicable laws.

We may also disclose your personal information to parties acquiring part or all of Our assets, as well as to attorneys and consultants. Also, if any bankruptcy or reorganization proceeding is brought by or against Us, your information may be considered a company asset that may be sold or transferred to third parties.

4. Your Choices

You may request access to, modify, correct, delete or limit the use and disclosure, where required by applicable law, of your account information or close your account. You can also request additional information We may have about your account.

4.1 Access, correct, delete or limit use of your personal information and Closing your account

You may (1) request access to, modification or correction of, deletion of, or limit or object to the use and disclosure, where required by applicable law, of your personal information controlled by Us or (2) close your account. You can request access to your personal information held by Us, including information that is not viewable through the Mobile App (for example, your IP access logs) through Our customer support center at: 1-800-314-4705 or by e-mail at: support@pocketgeek.com. You can also request as by sending a written request to Us at the address provided in the “Contact Us” section of this Notice. You may also delete your account from within the mobile app. This will not affect your mobile protection; it will just delete your credentials and data from systems.

If you close your account(s), your information, including device information that you have provided will be removed from the Service 30 days after cancellation/termination. We delete logs and other information through the deletion process within 90 days of account closure, except as noted in Section 3.3.

If you think that any personal information, We have collected about you is inaccurate, or if you would like to limit the use and disclosure of such information, you may send a reasonable written request for review to Us at the address provided below in the “Contact Us” section of this Notice. We will investigate your request and make appropriate changes or deletions if warranted. We will respond to any reasonable requests for access to personal information in 45 days or as permitted under applicable law.

In certain situations, and subject to applicable laws, we may not be able to provide access to all of the personal information that We hold about you. For example, We may not provide access to information if doing so:

5. Important Information

5.1 Data Retention

We keep your information for as long as your account is active or as needed. In addition, We may keep certain information even after you close your account if it is necessary to comply with Our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce this agreement.

We retain personal information you provide while your account is active or as needed to provide the Service. If you or We cancel or terminate Pocket Geek Home service, your information, including device information that you have provided will be removed from the Service 30 days after cancellation/termination. We delete logs and other information through the deletion process within 90 days of account closure.

Our customer support may retain information for as long as is necessary to provide support-related reporting and trend analysis only, but We generally delete or anonymize closed account data consistent with this Notice.

We may retain your personal information for longer than the periods set out above where necessary, for example to comply with Our legal obligations, meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce Our Terms of Service.

5.2 Changes to this Privacy Notice

We may update this Privacy Notice from time to time. If We make any material changes to this Privacy Notice, We will notify you by the Mobile App, or by other means prior to the change becoming effective, so that you may review the changes before you continue to use the Service. As We may make changes to this Privacy Notice, We suggest that you review it each time you access and use the Service. Please review changes carefully. If any changes are made to this Privacy Notice, We will revise the Effective Date that is indicated at the bottom of it.

5.3 Security Procedures

We have measures in place to restrict access to information to those employees and individuals whom We know have a valid business purpose to have access to such data. We maintain physical, electronic and procedural safeguards. We follow generally accepted standards designed to protect the personal information submitted to Us, both during transmission and once We receive it. We require those who provide services for Us and to whom We provide information collected through the Service to keep such information safeguarded and confidential. However, no method of transmission over the Internet or method of electronic storage is totally secure. Therefore, We cannot guarantee its absolute security.

User Analytics Notice

Analyze Mobile App Performance

We collect personal information, on an individual and collective basis based on your consent, to track and analyze preferences and trends, improve the quality of the Mobile App, evaluate possible new features, functionality and services, and improve Our Mobile App. We collect information when you use Our Mobile App, and use third party analytics tools to evaluate user traffic. For example, We collect information when you view a Mobile App screen. Additionally, We collect log in information about devices used to access Our Service, including user ID, device information (e.g., device manufacturer, OS), and how you use the Mobile App (e.g., when you tap the add button).

What types of cookies (or analytics) are used with the Mobile App?

We use first party cookies (or analytics) with the Mobile App. The analytics used in our Mobile App can be categorised in the following ways:

Purpose **These analytics tools collect information about how a user interacts with a mobile app. For instance, which screens visitors go to most often, and if they get error messages. The information collected is used to improve Mobile App performance. **
